Javelin Agency uses GoHighLevel as its primary CRM, funnel builder, automation platform, and communications system. GoHighLevel may be used to manage customer data, contact records, conversations, forms, workflows, SMS communications, emails, calls, and related automation activity. Javelin Agency may also use LC Phone through GoHighLevel for phone and SMS-related features, Stripe for payments, and Squarespace for website hosting.
User Responsibilities
You agree to provide accurate, current, and complete information when contacting Javelin Agency, submitting forms, opting in to communications, or using our services.You are responsible for ensuring that any information you provide to Javelin Agency is lawful, accurate, and authorized. If you are a business client, you are responsible for ensuring that your use of our services complies with applicable laws, industry rules, carrier requirements, privacy laws, consumer protection laws, and messaging consent requirements.
Acceptable Use
You agree not to use Javelin Agency’s website or services to: Send unlawful, abusive, deceptive, fraudulent, harassing, or misleading communications. SMS Messaging Terms
Javelin Agency provides missed call lead automation and related communication services. You must be 18 years of age or older to use this SMS service. When you opt in to receive text messages from Javelin Agency, you may receive SMS messages related to missed call follow-up, call-back requests, service inquiries, confirmation messages, customer support, and related communication about our services. You can cancel the SMS service at any time. Just text STOP to +1 323-553-4361. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at main@javelin-agency.com or +1 323-553-4361.Carriers are not liable for delayed or undelivered messages. Javelin Agency does not directly store full payment card numbers. Payment information may be processed by Stripe or another third-party payment processor. Failure to pay required fees may result in suspension or termination of services.
Intellectual Property
All content on Javelin Agency’s website, including text, graphics, branding, logos, service descriptions, designs, workflows, templates, and other materials, is owned by Javelin Agency or used with permission. You may not copy, reproduce, modify, distribute, sell, or exploit Javelin Agency’s intellectual property without prior written permission. Any materials, workflows, automations, or systems created by Javelin Agency for a client may be subject to separate ownership terms in a written service agreement.
Client Content and Data
Clients may provide contact information, business information, customer communication data, or other content necessary for Javelin Agency to provide services. Clients are responsible for ensuring they have the lawful right and proper consent to provide any customer, lead, or contact information to Javelin Agency. Javelin Agency uses client data only to provide, support, maintain, and improve contracted services, and as described in our Privacy Policy. Javelin Agency does not sell lead data, does not share lead data for promotional use, and does not share SMS opt-in data or consent with affiliates or third parties for marketing purposes.
Third-Party Platforms
Javelin Agency uses third-party platforms to provide and support its services, including GoHighLevel, LC Phone, Stripe, and Squarespace. These third-party platforms may have their own terms, policies, and technical requirements. Javelin Agency is not responsible for outages, errors, delays, or service limitations caused by third-party platforms, carriers, internet providers, payment processors, or communication networks. Use of SMS, phone, email, and automation features may be subject to carrier rules, platform rules, A2P 10DLC requirements, and other compliance standards.
Disclaimers
Javelin Agency provides services on an “as available” and “as provided” basis. Javelin Agency does not guarantee that its website, communications, automations, CRM systems, SMS delivery, call tracking, or third-party platform integrations will be uninterrupted, error-free, or available at all times. Javelin Agency does not guarantee specific business results, revenue increases, lead conversion rates, sales outcomes, or customer responses from use of its services. SMS and call delivery may depend on carriers, wireless providers, user devices, platform settings, compliance approvals, and third-party systems outside of Javelin Agency’s control.
Limitation of Liability
To the fullest extent permitted by law, Javelin Agency will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost revenue, lost business opportunities, lost data, or service interruptions. Javelin Agency’s total liability for any claim related to the website or services will not exceed the amount paid by the client to Javelin Agency for the specific service giving rise to the claim during the three months before the claim arose. Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless Javelin Agency, its owners, employees, contractors, service providers, and affiliates from any claims, damages, liabilities, losses, costs, or expenses arising from: Your use of our website or services. You may stop using our services at any time, subject to any payment terms, service agreements, or cancellation terms that apply to your account. Termination does not affect any rights or obligations that arose before termination, including payment obligations, confidentiality obligations, limitations of liability, and indemnification obligations.
Governing Law
